Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Atelier Alba website at atelieralba.ca (the “Site”) and any purchases made through it. The Site is operated by Atelier Alba Inc., based in Toronto, Ontario, Canada (“Atelier Alba”, “we”, “us”). By using the Site or placing an order, you agree to these Terms.
Please also read our Shipping & Delivery Policy, Refund & Return Policy and Privacy Policy, which form part of these Terms.
1) Use of the Site
You agree to use the Site lawfully and not to:
violate any applicable laws or regulations
attempt to gain unauthorized access to the Site or its systems
interfere with the security or operation of the Site
copy, reproduce, or distribute Site content without permission
use automated means to scrape, harvest or republish our catalogue, imagery or pricing
2) Orders and Acceptance
All orders are subject to acceptance and availability. Placing an order is an offer to purchase; a contract is formed only when we accept it. We may refuse, cancel, or limit any order at our discretion, including for suspected fraud, pricing errors, or operational limitations.
If we cancel an order you have already paid for, we refund that payment in full to the original payment method.
3) Pricing and Payment
All prices are shown in Canadian dollars (CAD). Applicable taxes are calculated and displayed at checkout before you pay.
Payment is processed by Stripe. We never receive or store your full card number. Payment is taken at the time the order is placed.
If an item is listed at an incorrect price because of an error, we may cancel the order and refund you in full, including after payment.
4) Delivery Area
We offer free hand-delivery to addresses within 40 km of our Toronto atelier. Every arrangement is delivered by our own team; we do not use couriers and we do not ship. For an address outside this area, or if you are unsure whether an address is within it, please email [email protected] to confirm availability before placing your order.
You may place an order from anywhere, including from outside Canada, provided the delivery address is within our delivery area.
Our delivery area, timing, building access, peak dates and proof of delivery are set out in full in our Shipping & Delivery Policy. If anything in these Terms appears to differ from that policy on a delivery matter, the Shipping & Delivery Policy applies.
5) Floral Substitutions
Our arrangements are made by hand from fresh, seasonal and perishable flowers. Specific stems, varieties and colours depend on what is available at market on the day your order is made.
Where a flower shown in a photograph is unavailable, we substitute a bloom of equal or greater value in a comparable palette and style, so the arrangement remains faithful to the design you chose. Vessels and containers may also vary. A substitution made on this basis is not a defect and is not on its own grounds for a refund.
6) Recipient Information
You are responsible for giving us complete and accurate delivery details: the recipient’s full name and phone number, the full address including unit number, and any buzzer code or building access instructions. If a delivery cannot be completed because the information you provided was incomplete or incorrect, additional fees may apply and the order may not be eligible for a refund.
By giving us a recipient’s name and phone number you confirm you are entitled to share that information with us for the purpose of making the delivery.
7) Cancellations, Refunds and Store Credit
Because our products are perishable and made to order, cancellations, refunds and store credit are governed by our Refund & Return Policy. In short: you may cancel without charge if you contact us at least 48 hours before the scheduled delivery, and once an order has been delivered all sales are final, subject to the quality-issue process set out in that policy.
8) Intellectual Property
All content on the Site — photography, floral designs, text, the Atelier Alba name and logo, and the look and feel of the Site — is owned by Atelier Alba or used under licence, and is protected by copyright and trade-mark law. You may not reproduce, distribute or create derivative works from it without our written permission.
If you send us photographs or messages, for example a photograph of a delivered arrangement or a review, you grant us a non-exclusive, royalty-free licence to use them to operate and promote our business. You may withdraw that permission at any time by writing to us.
9) Card Messages and Delivery Notes
You are responsible for anything you ask us to write on a gift card or include in delivery notes. We may decline to reproduce a message that is unlawful, harassing, hateful, defamatory, or that we reasonably believe is intended to cause harm, and we may cancel and refund such an order.
10) Disclaimers
The Site is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted or error-free. Flower photography is representative; natural variation in colour, size and form is inherent to fresh flowers.
Cut flowers are perishable, and their lifespan depends on care and handling after delivery and on ambient conditions. We cannot guarantee the condition of an arrangement once delivery is complete.
11) Limitation of Liability
To the fullest extent permitted by law, our total liability to you in connection with any order or your use of the Site will not exceed the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, special or consequential losses, including disappointment, loss of enjoyment of an occasion, or loss of profit.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for fraud or for death or personal injury caused by negligence.
12) Your Consumer Rights
If you are a consumer in Ontario you have rights under the Consumer Protection Act, 2002 (Ontario) and other applicable consumer protection law. Nothing in these Terms or in any of our policies removes, restricts or waives those statutory rights, and any term that purported to do so does not apply to you.
13) Indemnity
You agree to indemnify Atelier Alba against claims, losses and reasonable legal costs arising from your breach of these Terms, your misuse of the Site, or content you asked us to reproduce.
14) Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it. The courts of Ontario have jurisdiction over any dispute, without limiting any right you may have to bring a claim where you live if the law gives you that right.
15) Changes to These Terms
We may update these Terms from time to time. The version in force when you place an order governs that order. We update the effective date above whenever we make a change.
